CARTOON & CARICATURE TERMS OF SERVICE

By choosing to accept a quote, and purchase services from UbiKartun.com, collectively referred to hereafter as UbiKartun, you agree to the following terms of service which apply to the sites, www.ubikartun.com and all pages contained within the site:

SATISFACTION GUARANTEE:
UbiKartun guarantees that any person purchasing cartoon design or caricature which are directly produced by UbiKartun, through the website, will be satisfied with the items they receive. If the customer is dissatisfied for any reason, the artwork will be replaced with the same item only, which will be recreated to meet the client's satisfaction, at no additional cost.

IP/TRADEMARKS/COPYRIGHTS:

• CARTOON DESIGN:
  Ownership (copyright and title) of the final artwork becomes the property of the client, having unlimited, indefinite, and royalty-free use of the image upon project completion and receipt of full payment. UbiKartun retains rights to display the artwork in portfolio and advertising materials. All concepts, comprehensives, or other preliminary materials, which are not selected by the client or are not included into the final delivery, remain the full property of UbiKartun.

  In the event that payment for any cartoon design is not made in accordance with the payment policies of UbiKartun, then all of client's rights in and to the design created for it, including any trademark property, will immediately revert back to UbiKartun.
  
  Although each cartoon design is created from scratch and is 100% original, UbiKartun cannot guarantee that a very similar cartoon does not already exist. UbiKartun therefore offers no guarantee regarding the availability of trade names or trademarks. If a similar cartoon exists, UbiKartun will work with the client to make the necessary alterations to the cartoon, free of charge. However, by ordering a cartoon design from UbiKartun, the customer indemnifies UbiKartun, it's owners and affiliated companies/affiliated individuals/cartoon designers from legal responsibility regarding all copyright, trade name and trademark issues. The customer agrees to take sole legal responsibility should the cartoon design be infringent upon existing intellectual property rights, copyrighted material, trade names or trademarks of any kind.

• CARTOON CARICATURE:
  Ownership (copyright and title) of the final artwork becomes the property of the UbiKartun. All artwork created for individuals or organizations is for personal use only and not to be reprinted, published, duplicated or used for any commercial applications without the consent of UbiKartun. UbiKartun reserves the right to reuse/reproduce images of artworks which we have created, and/or their likeness or derivations, in any manner. In the event that the customer wishes we do not use art/images created for said customer in any other manner, and expresses so in writing, we will respectfully refrain from reproducing such images.

PRIVACY POLICY:
UbiKartun promises that any and all information provided by clients during the process of acquiring services will be kept confidential and shared with no other individuals or organizations for any purpose. However, such information may be used by UbiKartun in the event of promotions which we may determine to be of interest to said customers.

ITEMS OFFERED THROUGH AFFILIATE PROGRAMS:
Products including t-shirts, posters, prints, and others, may be displayed on the UbiKartun website, but produced and/or sold by other companies through affiliate programs in which UbiKartun is involved. UbiKartun does not warrant or guarantee any of such products. Problems, issues, concerns or questions resulting from the purchase of such items are to be directed to the company which produced/provided and shipped the items. Information displayed including descriptions, prices and other information related to such items is not provided by UbiKartun, therefore, UbiKartun has no obligation to the accuracy of information.

CONTENT OF UBIKARTUN WEBSITES:
All contents of www.ubikartun.com site and pages are the property of UbiKartun. No part of this site may be reproduced in whole or part, in any form or by any means, without the prior written permission of the owner.
